What Is Probate?

Probate is the legal process by which the assets owned by the deceased individual are administered. The primary goal of probate is two fold: first, to settle the debts of the estate, and second, to transfer ownership of property.

Stages of Probate Litigation

Probate litigation in Tennessee involves five stages:

  • Stage #1: Filing The Petition: The process begins when the executor (named in the will) or a petitioner (when there is no will) applies to the court.
  • Stage #2: Notice To Creditors and Beneficiaries: The executor, usually through an attorney, notifies creditors and beneficiaries with a stake in the estate.
  • Stage #3: Payment of The Estate’s Debts, Taxes, and Expenses: Prior to inheriting any property, the decedent’s debts must be settled. This includes credit cards, mortgages, back taxes, bills, and attorney fees.
  • Stage #4: Legal Title in Property Transfers In Accordance With Will And/Or Local Law: After the estate resolves its debts, the executor”s attorney petitions the court to transfer the remaining assets to the beneficiaries as specified in the will or according to local laws.
  • Stage #5: Closing the Probate Estate: The executor attorney prepares a final account and a petition for final distribution. A hearing is scheduled, with notice given to interested parties. Creditors are paid, and assets are formally distributed.

Can The House Be Sold During The Probate Process?

It depends.. If the Executor receives an acceptable offer during the probate period the attorney can present it to the Judge for approval. My experience has been that if the estate is “solvent”, meaning there are enough assets to cover any outstanding liens, the Judge usually approves the sale.

What Happens To The Money If The House Is Sold During The Probate Period?

If the house is sold during the probate period, the proceeds will go into the estate account. Once the probate period has expired and all liens are paid out of the account then the balance will be distributed.

Will I As The Executor Need To Be At The Closing?

Not necessarily.. We have bought many inherited properties from folks living out of state. The documents are usually overnighted, signed and notarized then returned. The title company we use is well versed in this process.

Will All The Heirs Need To Be At The Closing?

Again, not necessarily.. My experience has been that the title company will need to have the heirs sign some documents. If they can not make it to closing then these documents can be overnighted, signed and notarized then returned.

How Does The Process Work If I’ve Already Inherited The Property?

If you have already gone all the way thru the probate process and the estate is closed then it will be handled as if it were your personal house. No need to involve the courts at that time.
